Action by Thomas Ponce and Victoria Ponce, minors, through Jack McManus, their guardian ad litem, against defendants Fred W. Hinney, American Motorists Insurance Company (Hinney's insurance carrier) and Iowa National Mutual Insurance Company (hereinafter ""Iowa National"") to recover damages for personal injuries sustained as the result of an automobile collision. The collision occurred January 20, 1963, between automobiles driven by Hinney and Joseph LaCaria (hereinafter LaCaria), stepfather of the two minor plaintiffs. While LaCaria was not named as a party defendant, Iowa National, his insurance carrier, was. Iowa National defended on the ground that the parental-immunity doctrine prevented recovery against its insured LaCaria because at the time of the accident he stood in loco parentis to the minor plaintiffs.
